1. Acceptance of Terms

By accessing or using MyLoanBook ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

MyLoanBook provides a trail book management platform for Australian mortgage brokers. The Service includes tools for tracking commissions, managing client relationships, scheduling reviews, and analyzing trail income.

3. Account Registration

To use the Service, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activity under your account

4. Subscription and Billing

The Service is offered on a subscription basis:

• Beta access: available by invitation — contact nick@digitalbrokerlabs.dev
• Subscriptions are billed monthly
• You may cancel at any time; access continues until end of billing period
• Failed payments trigger a 5 business day grace period
• Prices may change with 30 days notice

5. User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Not upload malicious files or content
• Maintain appropriate licenses (ACL/CRN) for your activities
• Ensure data you upload complies with privacy laws
• Not attempt to access other users' data
• Not reverse engineer or attempt to extract source code

6. Intellectual Property

The Service and its original content, features, and functionality are owned by MyLoanBook and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of data you upload.

7. Limitation of Liability

MyLoanBook provides the Service "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our liability is limited to the amount you paid for the Service in the past 12 months.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

9. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of Australia. Any disputes shall be resolved in the courts of New South Wales, Australia.
